The bill requires the secretary of state to coordinate the computerized statewide voter registration list with citizenship records maintained by federal and state agencies. Upon learning that a particular person registered to vote is not a United States citizen, the secretary of state, after conducting an administrative hearing, is directed to electronically cancel that person's voter registration record. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly hereby finds and declares that: (a) The ability of eligible electors to vote is one of the most fundamentally important and cherished rights in our nation and our state; (b) The general assembly is constitutionally obligated to pass laws to secure the purity of elections and guard against abuses of the elective franchise; (c) The secretary of state has unambiguous existing authority to detect and electronically cancel the registrations of electors who are deceased or have been convicted of a felony, but there is no explicit analogous authority pertaining to removal of noncitizens from the voter registration record; and (d) Therefore, consistent with the foregoing, the general assembly finds it necessary to: (I) Direct the secretary of state to ensure that the names of persons who are not citizens of the United States and thus ineligible to vote do not appear in the voter registration record; and (II) Clearly affirm the ability of the secretary of state to cancel ineligible voters from the voter registration record. SECTION 2. In Colorado Revised Statutes, 1-2-302, add (3.5) (c) as follows: 1-2-302. Maintenance of computerized statewide voter registration list - confidentiality. (3.5) (c) The secretary of state shall coordinate the computerized statewide voter registration list with records maintained by federal and state agencies, including the United States department of homeland security, that pertain to or contain citizenship status data. Upon obtaining information that a particular person registered to vote is not a United States citizen, the secretary of state shall, after a hearing conducted in accordance with section 24-4-105, C.R.S., electronically cancel that person's voter registration record. SECTION 3. No appropriation. The general assembly has determined that this act can be implemented within existing appropriations, and therefore no separate appropriation of state moneys is necessary to carry out the purposes of this act. SECTION 4. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
