Current law requires the payment of a daily vehicle rental fee of $2 on the rental of any vehicle required to be registered that is rented in the state. Such a vehicle is exempt from the road safety and bridge safety surcharges imposed on other vehicles at the time of registration. The bill exempts vehicles that weigh at least 10,000 pounds declared empty vehicle weight from the daily vehicle rental fee and subjects such vehicles to the road safety and bridge safety surcharges. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 43-4-804, amend (1) (b) (I) as follows: 43-4-804. Highway safety projects - surcharges and fees - crediting of moneys to highway users tax fund. (1) On and after July 1, 2009, the following surcharges, fees, and fines shall be collected and credited to the highway users tax fund created in section 43-4-201 (1) (a) and allocated to the state highway fund, counties, and municipalities as specified in section 43-4-205 (6.3): (b) (I) Except as otherwise provided in subparagraph (III) of this paragraph (b), a daily vehicle rental fee, which shall be is imposed on the rental of any vehicle rented in the state at the rate of two dollars per day; except that the fee is not imposed on any vehicle that weighs at least ten thousand pounds declared empty vehicle weight and is rented during a registration period for the vehicle that begins on or after the effective date of this subparagraph (I), as amended. Any person who owns vehicles that are based in Colorado for rental purposes or who owns vehicles that are based in a state other than Colorado for rental purposes but rents such vehicles from a business location in Colorado and whose primary business is the rental of such vehicles for periods of less than forty-five days, including renewals, to another person shall collect the daily vehicle rental fee from the renter of each vehicle rented. The rental invoice shall must list the daily vehicle rental fee separately as a Colorado road safety program fee. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
