Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill creates the advanced placement incentives pilot program (pilot program) in the department of education. If a rural school district, as defined by the department of education, has 3,000 or fewer total K-12 students, a school within that rural school district is eligible to participate in the pilot program. The participating schools, as well as the teachers or mentors for on-line classes, are eligible to receive bonuses through the pilot program for successful completion of advanced placement classes and passage of advanced placement exams. Additional bonuses are available if the passing student is eligible for the federal student lunch program. The pilot program is repealed after 4 years. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add article 94 to title 22 as follows: ARTICLE 94 Advanced Placement Incentives Pilot Program 22-94-101. Definitions. As used in this article unless the context otherwise requires: (1) "Department" means the department of education created and existing pursuant to section 24-1-115, C.R.S. (2) "Pilot program" means the advanced placement incentives pilot program created in section 22-94-102. (3) "Rural school" means any public high school within a rural school district, which rural school district has an enrollment of three thousand or fewer students in kindergarten through twelfth grade. (4) "Rural school district" means a school district which the department has determined to be rural after giving consideration to the size of the school district, the distance from the nearest large urbanized area, and whether the school district has an enrollment of less than approximately six thousand five hundred students in kindergarten through twelfth grade. (5) "School lunch program" means the federal "National School Lunch Act" created in 42 U.S.C. sec. 1751 et seq. 22-94-102. Advanced placement incentives pilot program - creation - administration - teacher incentives. (1) There is hereby created in the department the advanced placement incentives pilot program to expand access to advanced placement classes in rural schools and enhance the participation in advanced placement programs by students in the school lunch program. (2) Only a rural school may participate in the pilot program, and the pilot program is limited to the first ten thousand students from rural schools. In order to be eligible to participate in the pilot program, a rural school shall: (a) Require all tenth-grade students to take the PSAT or ACT PLAN exam to help identify students with the potential to pass an advanced placement exam; and (b) Have an advanced placement program with at least one advanced placement class in the area of math, science, or English. A rural school or rural school district may offer an advanced placement class or program on-line. If a class is offered on-line, the rural school or rural school district shall designate an on-site mentor for student support. The mentor is eligible for the teacher incentives provided for in subsection (3) of this section. (3) (a) Regardless of the outcome of the advanced placement exams taken, for each student who takes the advanced placement exam and completes an advanced placement class, the rural school shall receive five hundred dollars to be used for: (I) Implementing a school-wide advanced placement program, including enhancing on-line access for rural schools that have limited access; (II) Professional development to assist teachers in learning instructional strategies for teaching advanced placement classes and bolstering advanced placement content knowledge; (III) Professional development for administrators concerning the content required in nonadvanced placement classes to help students prepare for future success in advanced placement classes; and (IV) The advanced placement exam fee for each student in the student lunch program, unless the exam fee is covered by a federal grant program. (b) For each student who takes and passes an advanced placement exam, the participating rural school shall receive an additional five hundred dollars that must be used to enhance the advanced placement program and to pay for teacher and mentor incentives as follows: (I) A teacher or mentor shall receive seventy-five dollars for each of his or her students who passes an advanced placement exam; and (II) A teacher or mentor may not receive more than two thousand dollars per year in bonuses from the pilot program. (4) On or before December 1, 2013, the department shall develop and make available guidelines for participation in the pilot program. 22-94-103. Repeal. This article is repealed, effective July 1, 2017. 22-94-104. Funding. The general assembly finds that, for purposes of section 17 of article IX of the state constitution, the advanced placement incentives pilot program created in this article is an important component of an accountable program to meet state academic standards and, therefore, may be funded from moneys in the state education fund created in section 17 (4) of article IX of the state constitution. SECTION 2. Appropriation. (1) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the state education fund not otherwise appropriated, to the department of education, for the fiscal year beginning July 1, 2013, the sum of $710,529 and 0.4 FTE, or so much thereof as may be necessary, to be allocated to professional development and instructional support programs for the implementation of this act as follows: (a) $26,529 and 0.4 FTE for personal services; and (b) $684,000 for incentive awards. SECTION 3. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 7, 2013, if adjournment sine die is on May 8, 2013); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
