SENATE BILL 13-232 BY SENATOR(S) Hodge, Steadman, Lambert, Kerr; also REPRESENTATIVE(S) Gerou, Duran, Levy, Fields, Hullinghorst, Kagan, Labuda, McCann, Rosenthal, Schafer, Singer, Young. Concerning continuation of transfers for medicaid disease management programs, and, in connection therewith, making and reducing appropriations. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-22-117, amend (2) (d) (IV.5) as follows: 24-22-117. Tobacco tax cash fund - accounts - creation - legislative declaration - repeal. (2) There are hereby created in the state treasury the following funds: (d) (IV.5) For fiscal year 2008-09, and each fiscal year thereafter, until and including fiscal year 2012-13, after the allocation and transfer required by subparagraphs (II) and (III) of this paragraph (d), of the moneys in the prevention, early detection, and treatment fund, two million dollars shall be transferred to the department of health care policy and financing for medicaid disease management and treatment programs, authorized by section 25.5-5-316, C.R.S., that address cancer, heart disease, and lung disease or the risk factors associated with such diseases. SECTION 2. Appropriation - adjustments to 2013 long bill. (1) For the implementation of this act, appropriations made in the annual general appropriation act to the department of health care policy and financing for the fiscal year beginning July 1, 2013, are adjusted as follows: (a) The general fund appropriation for medical services premiums is decreased by $2,000,000. (b) The reappropriated funds appropriation for medical services premiums is increased by $2,000,000. Said sum is from reappropriated funds received from the department of public health and environment out of the appropriation made in subsection (3) of this section. (2) For the implementation of this act, appropriations made in the annual general appropriation act to the department of public health and environment for the fiscal year beginning July 1, 2013, are adjusted as follows: (a) The cash funds appropriation for cancer, cardiovascular disease, and chronic pulmonary disease grants is decreased by $2,000,000. Said sum is from the prevention, early detection, and treatment fund created in section 24-22-117 (2) (d) (I), Colorado Revised Statutes. (3) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the prevention, early detection, and treatment fund created in section 24-22-117 (2) (d) (I), Colorado Revised Statutes, not otherwise appropriated, to the department of public health and environment, for the fiscal year beginning July 1, 2013, the sum of $2,000,000, or so much thereof as may be necessary, for allocation to the transfer to the department of health care policy and financing for disease management line item for implementation of this act. SECTION 3. Safety clause.
