The bill repeals the "Colorado Health Benefit Exchange Act" if the "Patient Protection and Affordable Care Act" as amended by the "Health Care and Education Reconciliation Act of 2010" (federal act) is repealed or the United States supreme court rules that all or any part of the federal act is unconstitutional. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 10-22-109 as follows: 10-22-109. Repeal of article. If the federal act is repealed or the United States supreme court rules that all or any part of the federal act is unconstitutional, including the establishment of the health benefit exchanges and the individual mandate to purchase health insurance, the governor, after consultation with the attorney general, shall report this fact in writing to the revisor of statutes. Upon receipt by the revisor of statutes of the written report, this article is repealed. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
