The bill allows the board of directors of the grand valley drainage district to adopt a resolution exempting the district and the district's maintenance efforts from excavation requirements. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 37-31-137, add (1) (d) as follows: 37-31-137. Property taxable and service fees chargeable by district. (1) In order to carry out the purposes of the district and the provisions of this article, the board of directors has the following powers: (d) To adopt a resolution, which until repealed has the force of law, exempting the district and the district's maintenance efforts concerning seepage and drainage works from any duties, obligations, and liabilities set forth or construed to arise out of article 1.5 of title 9, C.R.S. SECTION 2. In Colorado Revised Statutes, add 9-1.5-108 as follows: 9-1.5-108. Grand valley drainage district - exemption. The board of directors of the grand valley drainage district may adopt a resolution exempting the district and the district's maintenance efforts concerning seepage and drainage works from all duties, obligations, and liabilities set forth or construed to arise out of this article. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
