For the fiscal year 2012-13, the bill requires the general assembly to reduce the total state general fund appropriations to the legislative branch, the judicial branch, and each executive department, excluding the department of health care policy and financing and the department of education, by an amount equal to the general fund appropriations to the respective branch or department for the fiscal year 2011-12 multiplied by the current rate of unemployment as of March 1, 2012. The bill also requires the state treasurer on January 1, 2013, to transfer an amount equal to the total reduction in general fund appropriations to the state education fund. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 24-75-220 as follows: 24-75-220. General fund - appropriation limit - surplus - transfer - state education fund - repeal. (1) (a) Except as set forth in paragraph (b) of this subsection (1), for the fiscal year 2012-13, the general assembly shall reduce the total state general fund appropriations to the legislative branch, the judicial branch, and each executive department by an amount equal to the general fund appropriations to the respective branch or department for the fiscal year 2011-12, multiplied by the current rate of unemployment published by the United States department of labor bureau of labor statistics as of March 1, 2012. (b) Paragraph (a) of this subsection (1) shall not apply to the department of health care policy and financing or the department of education. (2) On January 1, 2013, the state treasurer shall deduct an amount equal to the total reduction in general fund appropriations required by subsection (1) of this section and transfer such sum to the state education fund created in section 17 (4) of article IX of the state constitution. (3) This section is repealed, effective July 1, 2013. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
