      HOUSE BILL 12-1343
      
      
      BY REPRESENTATIVE(S) Gerou, Becker, Levy, Young;
      also SENATOR(S) Hodge, Steadman, Lambert.
      
      
      Concerning the transfer of moneys from the state rail bank fund
           to the general fund.
      
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  In Colorado Revised Statutes, 43-1-1309, add (4) as
      follows:
      
           43-1-1309.  State rail bank fund - creation.
      (4)  Notwithstanding any provision of subsection (1) of this section
      to the contrary, the state treasurer shall transfer to the
      general fund any unexpended and unencumbered moneys
      remaining in the state rail bank fund as of June 30, 2012.
      
           SECTION 2.  Safety clause. The general assembly hereby finds,
      determines, and declares that this act is necessary for the immediate
      preservation of the public peace, health, and safety.
