Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill directs the secretary of state to develop an on-line program for the posting of election returns on election night. Such postings are required for all statewide elections, commencing with the 2012 primary election. To implement the program, upon passage of the bill, $776,460 is appropriated to the department of state from the department of state cash fund. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 1-7-604 as follows: 1-7-604. Electronic posting of election returns on election night by the secretary of state. The secretary of state shall, at no cost to the county clerk and recorders, develop and implement an on-line program specifically for posting statewide election-night returns on the secretary of state's official web site. Commencing with the 2012 primary election and for each statewide election thereafter, the secretary of state shall post the election returns prepared pursuant to section 1-7-602 on the official web site of the secretary of state by the evening of the date on which the primary, general, or other statewide election is held. SECTION 2. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the department of state cash fund created in section 24-21-104 (3) (b), Colorado Revised Statutes, not otherwise appropriated, to the department of state, the sum of $776,460, or so much thereof as may be necessary, for the implementation of this act. The moneys appropriated by this section shall become available upon passage of this act and shall remain available until July 1, 2013. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
