      SENATE BILL 12-092

      Ramirez, Schafer S., Tyler, Wilson.
      
      
      Concerning the use of a video display in a motor vehicle that is
           being operated on a roadway.
      
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  In Colorado Revised Statutes, 42-4-201, amend (3)
      as follows:
      
           42-4-201.  Obstruction of view or driving mechanism - hazardous
      situation. (3)  No A person shall not drive any a motor vehicle equipped
      with any television viewer, screen, or other means of visually receiving a
      television broadcast which is located in the motor vehicle at any point
      forward of the back of the driver's seat or which is a video display visible
      to the driver while operating the motor vehicle The provisions of is in
      motion. This subsection (3) shall not be interpreted to does not prohibit
      the usage of any a computer, data terminal, or other similar device safety
      equipment in a motor vehicle so long as the computer, data terminal,
      or safety equipment is not used to display visual entertainment,
      including internet browsing, social media, and e-mail, to the
      driver while the motor vehicle is in motion.
      
           SECTION 2.  Effective date - applicability. This act takes effect
      July 1, 2012, and applies to offenses committed on or after said date.
      
           SECTION 3.  Safety clause. The general assembly hereby finds,
      determines, and declares that this act is necessary for the immediate
      preservation of the public peace, health, and safety.
