The bill specifies that services performed at the Auraria higher education center by a student or a student's spouse who is employed as part of financial assistance to the student does not constitute employment making one eligible for unemployment insurance benefits. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 8-70-131, Colorado Revised Statutes, is amended to read: 8-70-131. Employment does not include - school - college - university - Auraria higher education center. (1) "Employment" does not include services performed in the employ of a school, college, or university or the Auraria higher education center, if such the service is performed: (a) By a student who is enrolled and is regularly attending classes at such the school, college, or university; or (b) By a student in the employ of the Auraria higher education center who is enrolled and is regularly attending classes at a school, college, or university; or (b) (c) By the spouse of such a student specified in paragraph (a) or (b) of this subsection (1), if such the spouse is advised, at the time such the spouse commences to perform such the service, that the employment of such the spouse to perform such the service is provided under a program to provide financial assistance to such the student by such the school, college, or university, or Auraria higher education center, and such the employment will not be covered by any program of unemployment insurance. SECTION 2. Effective date - applicability. This act shall take effect upon passage and shall apply to unemployment insurance claims on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
