SENATE BILL 11-239 BY SENATOR(S) Newell, Steadman; also REPRESENTATIVE(S) Swerdfeger, Conti, Kerr J., Pace, Swalm. Concerning the repeal of a requirement that the division of local government annually report about information related to incorporated municipalities to the clerk of each incorporated municipality. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Repeal. 24-32-110, Colorado Revised Statutes, is repealed as follows: 24-32-110. Report of district or municipal officials. The division of local government shall, on or before July 1 of each year, send a letter by certified or registered mail to the clerk of each incorporated municipality within the state whose population was shown by the last federal census to be less than one thousand people and shall require a report listing the names of the mayor, mayor pro tem, treasurer, and clerk of the municipality, the date of the last municipal election, and a certificate that the municipality is continuing to operate under its incorporation. SECTION 2. Act subject to petition - effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2011, if adjournment sine die is on May 11, 2011); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part shall not take effect unless approved by the people at the general election to be held in November 2012 and shall take effect on the date of the official declaration of the vote thereon by the governor. ____________________________ ____________________________ Brandon C.
