SENATE SPONSORSHIP Brophy, House Committees Senate Committees Transportation A BILL FOR AN ACT Concerning procedures to be followed by local authorities when closing certain routes to bicycle traffic. The bill specifies that a local authority may not prohibit the operation of bicycles or electrically assisted bicycles on a street or highway unless a suitable bike path, horseback trail, or other trail is available within a specified distance for use as an alternate route and an engineering and traffic investigation has been done to determine whether the operation of such vehicles is incompatible with the normal and safe movement of traffic. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. The introductory portion to 42-4-111 (1) and 42-4-111 (1) (h), Colorado Revised Statutes, are amended to read: 42-4-111. Powers of local authorities. (1) This article shall does not be deemed to prevent local authorities, with respect to streets and highways under their jurisdiction and within the reasonable exercise of the police power, except those streets and highways that are parts of the state highway system that are subject to section 43-2-135, C.R.S., from: (h) Regulating the operation of bicycles or electrical assisted bicycles and requiring the registration and licensing of same, including the requirement of a registration fee, consistent with the provisions of this article; except that, notwithstanding any provision of this article to the contrary, such vehicles may not be prohibited from using any street or highway unless the local authority complies with section 42-4-109 (11); SECTION 2. Effective date - applicability. This act shall take effect upon passage and shall apply to all local ordinances adopted on, before, or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
