Currently, a motor vehicle is subject to commercial safety rules and to inspections for compliance with the rules if the vehicle or combination of vehicles is used in commerce and has a gross vehicle weight rating of at least 10,001 pounds. The bill exempts pickup trucks, sport utility vehicles, and trailers with a gross combination rating of less than 26,001 pounds. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 42-4-235 (1) (a) (I), Colorado Revised Statutes, is amended, and the said 42-4-235 (1) is further amended BY THE ADDITION OF THE FOLLOWING NEW PARAGRAPHS, to read: 42-4-235. Minimum standards for commercial vehicles - repeal. (1) As used in this section, unless the context otherwise requires: (a) "Commercial vehicle" means: (I) Any self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer's gross vehicle weight rating or gross combination rating of at least ten thousand one pounds or more, which if the vehicle is used in commerce on the public highways of this state or is designed to transport sixteen or more passengers, including the driver, unless: such (A) The combination of vehicles is a sport utility vehicle or pickup truck and trailer with a gross combination rating of less than twenty-six thousand one pounds; (B) The vehicle is a school bus regulated pursuant to under section 42-4-1904 or any vehicle that does not have has a gross vehicle weight rating of less than twenty-six thousand one or more pounds and that is owned or operated by a school district so long as such school district does not receive remuneration for the use of such vehicle, not including reimbursement for the use of such the vehicle; (d) "Pickup truck" means a truck designed with an open-top rear cargo bed that is separate from the cab and typically marketed and sold to individuals for noncommercial use. (e) "Sport utility vehicle" means a vehicle with a chassis that is similar to a truck designed for occasional off-road use and typically marketed and sold to individuals for noncommercial use. SECTION 2. Effective date - applicability. This act shall take effect July 1, 2011, and shall apply to acts committed on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
