First Regular Session Sixty-eighth General Assembly STATE OF COLORADO INTRODUCED LLS NO. 11-0697.03 Bart Miller SENATE BILL 11-202 SENATE SPONSORSHIP Cadman, HOUSE SPONSORSHIP Gardner B., Senate Committees House Committees Local Government A BILL FOR AN ACT Concerning the authority for the proceeds of the transfer of a hospital owned by certain types of local governments to be used for a public purpose if the public purpose is approved by the voters of the local government. The bill allows the proceeds of the transfer of a hospital owned by a municipality or county to be used for any public purpose if the municipality or county refers a ballot question to the voters of the municipality or county authorizing the public purpose for which the proceeds will be used, and a majority of the voters voting in the election approve the ballot question. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 6-19-403, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 6-19-403. Certification and criteria. (2) Notwithstanding any other law, for any covered transaction involving a hospital owned by a municipality or county, a municipality or county may use the proceeds of the covered transaction for any public purpose, and paragraphs (a), (b), (f), and (i) of subsection (1) of this section and section 6-19-405, do not apply so long as the municipality or county refers to the voters of the municipality or county for their approval a ballot question authorizing the public purpose for which proceeds of the covered transaction will be used. If a majority of the voters voting in the election approve the ballot question, the proceeds may be used as approved by the voters. SECTION 2. 6-19-102, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 6-19-102. Definitions. As used in this article, unless the context otherwise requires: (4) "Municipality" has the same meaning as set forth in section 31-1-101 (6), C.R.S. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
