Current law restricts the compensation that county treasurers can receive for collecting drainage district and irrigation district assessments to not less than $25 or more than $100 each year. The bill increases county treasurers' compensation for those services to the following amounts, which are identical to the treasurers' compensation for the analogous services provided to special districts: In counties of the first class, one percent of the amount collected; second class, 1.5%; third class, 2%; fourth class, 3%; and fifth class, 5%. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 30-1-102 (1) (o) and (1) (p), Colorado Revised Statutes, are amended to read: 30-1-102. Fees of county treasurer. (1) The county treasurer shall charge and receive the following fees: (o) For services in collecting drainage district and irrigation district assessments, such amount as the board of directors of the district may allow, but not less than twenty-five dollars nor more than one hundred dollars per annum the percentages specified in paragraph (b) of this subsection (1); (p) For services in collecting irrigation district assessments, such amount as the board of directors of the district may allow, but not less than twenty-five dollars nor more than one hundred dollars per annum; SECTION 2. Act subject to petition - effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2011, if adjournment sine die is on May 11, 2011); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part shall not take effect unless approved by the people at the general election to be held in November 2012 and shall take effect on the date of the official declaration of the vote thereon by the governor.
