Concerning the waiver of copayments and deductibles by school-based health centers. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. The introductory portion to 18-13-119 (3), Colorado Revised Statutes, is amended, and the said 18-13-119 is further amended BY THE ADDITION OF A NEW SUBSECTION, to read: 18-13-119. Health care providers - abuse of health insurance. (3) Except as otherwise provided in subsections (5), and (6), and (8) of this section, if the effect is to eliminate the need for payment by the patient of any required deductible or copayment applicable in the patient's health benefit plan, a person who provides health care commits abuse of health insurance if he the person knowingly: (8) The waiver of a required deductible or copayment for health care services provided by a school-based health center, as defined in section 25-20.5-502, C.R.S., is exempt from the provisions of this section. SECTION 2. Safety clause.
