House Bill 07-1341 altered the composition of the Colorado oil and gas conservation commission (commission) by: Increasing the size of the commission from 7 to 9 members (adding the executive directors of the departments of public health and environment and natural resources as ex officio voting members); Reducing from 5 to 3 the number of members with substantial experience in the oil and gas industry; and Including a representative of local government. The bill restores the commission to its pre-House Bill 07-1341 composition, and specifies the type of experience required for certain industry members. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 34-60-104 (2) (a) (I), Colorado Revised Statutes, is amended to read: 34-60-104. Oil and gas conservation commission - report - publication. (2) (a) (I) Effective July 1, 2007 2011, the commission shall consist consists of nine eleven members, seven nine of whom shall be are appointed by the governor with the consent of the senate and two of whom, the executive director of the department of natural resources and the executive director of the department of public health and environment, shall be are ex officio voting nonvoting members. At least two The governor shall appoint the nine voting members in accordance with the following: (A) Geographical representation. At least three members shall be appointed from west of the continental divide, one member from the eastern slope, and, to the extent possible, consistent with this paragraph (a), the other members shall be appointed taking into account the need for geographical representation of other areas of the state with high levels of oil and gas activity or employment. The member appointed from the eastern slope and at least one member appointed from west of the continental divide must be members with substantial experience in the oil and gas industry. (B) Particular qualifications. Three Five members shall be individuals with must have substantial experience in the oil and gas industry, and at least two of said three those five members shall must have a college degree in petroleum geology or petroleum engineering; one member shall be a local government official; one member shall have formal training or substantial experience in environmental or wildlife protection conservation; one member shall have formal training or substantial experience in soil conservation or reclamation; and one member shall be actively engaged in agricultural production and also be a royalty owner. (C) Political party affiliation. Excluding the executive directors from consideration, no more than four five members of the commission shall be members of the same political party. SECTION 2. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the oil and gas conservation and environmental response fund created in section 34-60-122, Colorado Revised Statutes, not otherwise appropriated, to the department of natural resources, for allocation to the oil and gas conservation commission, for the fiscal year beginning July 1, 2011, the sum of one thousand one hundred eighty-two dollars ($1,182), or so much thereof as may be necessary, for the implementation of this act. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
