R10-1043.01 Esther van Mourik SCR10-006 SENATE SPONSORSHIP Lundberg, HOUSE SPONSORSHIP (None), Senate Committees House Committees State, Veterans & Military Affairs SENATE CONCURRENT RESOLUTION 10-006 Submitting to the registered electors of the state of Colorado an amendment to section 17 (1) of article IX of the constitution of the state of Colorado, concerning the rate of growth for public education funding when the rate of inflation is five percent or greater. The concurrent resolution allows the general assembly the discretion to set the rate of growth for public education funding when the rate of inflation is 5% or greater. Be It Resolved by the Senate of the Sixty-seventh General Assembly of the State of Colorado, the House of Representatives concurring herein: SECTION 1. At the next election at which such question may be submitted, there shall be submitted to the registered electors of the state of Colorado, for their approval or rejection, the following amendment to the constitution of the state of Colorado, to wit: Section 17 (1) of article IX of the constitution of the state of Colorado is amended to read: Section 17. Education - Funding. (1) Purpose. In state fiscal year 2001-2002 through state fiscal year 2010-2011, the statewide base per pupil funding, as defined by the Public School Finance Act of 1994, article 54 of title 22, Colorado Revised Statutes, on the effective date of this section, for public education from preschool through the twelfth grade and total state funding for all categorical programs shall grow annually at least by the rate of inflation plus an additional one percentage point. In state fiscal year 2011-2012, and each fiscal year thereafter, the statewide base per pupil funding for public education from preschool through the twelfth grade and total state funding for all categorical programs shall grow annually at a rate set by the general assembly that is at least equal to the rate of inflation; except that, if the rate of inflation is five percent or greater, the general assembly shall have the discretion to set the rate of growth for such fiscal year at five percent or greater. SECTION 2. Each elector voting at said election and desirous of voting for or against said amendment shall cast a vote as provided by law either "Yes" or "No" on the proposition: "Shall there be an amendment to section 17 (1) of article IX of the constitution of the state of Colorado, concerning the rate of growth for public education funding when the rate of inflation is five percent or greater?" SECTION 3. The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law for the canvassing of votes for representatives in Congress, and if a majority of the electors voting on the question shall have voted "Yes", the said amendment shall become a part of the state constitution.
