R10-0915.01 Troy Bratton HCR10-1001 HOUSE SPONSORSHIP Weissmann, Benefield, Curry, Kerr J., May, McFadyen, Merrifield, Vaad SENATE SPONSORSHIP (None), House Committees Senate Committees Local Government HOUSE CONCURRENT RESOLUTION 10-1001 Submitting to the registered electors of the state of Colorado an amendment to sections 8 and 15 of article XIV of the constitution of the state of Colorado, concerning the compensation of county officers, and, in connection therewith, authorizing the board of county commissioners of each county, rather than the general assembly, to set the salaries of the officers of that county including the county commissioners, clerk and recorder, sheriff, coroner, treasurer, assessor, and surveyor. The concurrent resolution eliminates the authority of the general assembly to set the salaries of county officers. Instead, the board of county commissioners of each county would have the authority to set the salaries of the officers of its respective county. Be It Resolved by the House of Representatives of the Sixty-seventh General Assembly of the State of Colorado, the Senate concurring herein: SECTION 1. At the next election at which such question may be submitted, there shall be submitted to the registered electors of the state of Colorado, for their approval or rejection, the following amendment to the constitution of the state of Colorado, to wit: Section 8 of article XIV of the constitution of the state of Colorado is amended to read: Section 8. County officers - election - term - salary. There shall be elected in each county, at the same time at which members of the general assembly are elected, commencing in the year nineteen hundred and fifty-four, and every four years thereafter, one county clerk, who shall be ex officio recorder of deeds and clerk of the board of county commissioners; one sheriff; one coroner; one treasurer who shall be collector of taxes; one county surveyor; one county assessor; and one county attorney who may be elected or appointed, as shall be provided by law; and such officers shall be paid such salary or compensation, either from the fees, perquisites and emoluments of their respective offices, or from the general county fund, as may be provided by law determined by the board of county commissioners. The term of office of all such officials shall be four years, and they shall take office on the second Tuesday in January next following their election, or at such other time as may be provided by law. Section 15 of article XIV of the constitution of the state of Colorado is amended to read: Section 15. Compensation and fees of county officers. The general assembly board of county commissioners shall fix the compensation of county the officers in this state by law, and of each county. The general assembly shall establish scales of fees to be charged and collected by such county the officers. All such fees shall be paid into the county general fund. Until the board fixes the compensation for the first time, the officers of a county shall receive compensation in the amount last set by the general assembly for officers of the county. When fixing the compensation of county officers, the general assembly shall give due consideration to county variations, including population; the number of persons residing in unincorporated areas; assessed valuation; motor vehicle registrations; building permits; military installations; and such other factors as may be necessary to prepare compensation schedules that reflect variations in the workloads and responsibilities of county officers and in the tax resources of the several counties. The compensation of any county officer shall be increased or decreased only when the compensation of all county officers within the same county, or when the compensation for the same county officer within the several counties of the state, is increased or decreased. County officers shall not have their compensation increased or decreased during the terms of office to which they have been elected or appointed. SECTION 2. Each elector voting at said election and desirous of voting for or against said amendment shall cast a vote as provided by law either "Yes" or "No" on the proposition: "Shall there be an amendment to sections 8 and 15 of article XIV of the constitution of the state of Colorado, concerning the compensation of county officers, and, in connection therewith, authorizing the board of county commissioners of each county, rather than the general assembly, to set the salaries of the officers of that county including the county commissioners, clerk and recorder, sheriff, coroner, treasurer, assessor, and surveyor?" SECTION 3. The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law for the canvassing of votes for representatives in Congress, and if a majority of the electors voting on the question shall have voted "Yes", the said amendment shall become a part of the state constitution.
