SENATE BILL 10-058 BY SENATOR(S) Tapia, Bacon, Boyd, Brophy, Foster, Gibbs, Heath, Hodge, Hudak, Johnston, Keller, Kester, King K., Mitchell, Morse, Newell, Penry, Romer, Schwartz, Shaffer B., Spence, Steadman, Tochtrop, Whitehead, Williams; also REPRESENTATIVE(S) Gagliardi, Apuan, Fischer, Gerou, Kefalas, Massey, Miklosi, Rice, Roberts, Scanlan, Schafer S., Soper, Summers, Todd. Concerning the eligibility requirements for the nursing teacher loan forgiveness pilot program. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 23-3.6-101 (6), Colorado Revised Statutes, is amended to read: 23-3.6-101. Definitions. As used in this part 1, unless the context otherwise requires: (6) "Qualified position" means full-time at least half-time employment by a public or participating private institution of higher education, to teach classes of which a majority of the time includes the classroom, clinical, and lab instruction required to earn a degree or certificate in nursing. SECTION 2. 23-3.6-102 (2) (c) and (2) (d), Colorado Revised Statutes, are amended to read: 23-3.6-102. Nursing teacher loan forgiveness pilot program - administration - fund - conditions. (2) In addition to any qualifications specified by collegeinvest, to qualify for the program, a nursing teacher shall: (c) Agree to teach in a qualified position for a period of not less than five consecutive academic years, beginning within four years after completion of the advanced degree specified in paragraph (a) of this subsection (2); (d) Teach in a qualified position for not less than five consecutive academic years, beginning within four years after completion of the advanced degree specified in paragraph (a) of this subsection (2); and SECTION 3. Act subject to petition - effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 11, 2010, if adjournment sine die is on May 12, 2010); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part shall not take effect unless approved by the people at the general election to be held in November 2010 and shall take effect on the date of the official declaration of the vote thereon by the governor. ____________________________ ____________________________ Brandon C.
