Currently, the state must fund 100% of the cost of tuition for Native American students enrolled at Fort Lewis college. The bill maintains that requirement for in-state students, but changes it to 100% of the cost of instruction for nonresident students. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 23-52-105 (1) (b) and (2), Colorado Revised Statutes, are amended to read: 23-52-105. Tuition fees - Native Americans. (1) (b) On and after September 1, 2002, the board of trustees shall fix tuition in accordance with the level of cash fund appropriations set by the general assembly for Fort Lewis college pursuant to section 23-1-104 (1) (a) (I), subject to the restriction that all qualified Indian Native American pupils shall at all times be admitted to such college free of charge for tuition and on terms of equality with other pupils. For qualified Native American pupils with in-state student status, the general assembly shall appropriate from the state general fund one hundred percent of the moneys required for in-state tuition for such qualified Indian pupils at Fort Lewis college. For qualified Native American pupils with nonresident status, the general assembly shall appropriate from the state general fund one hundred percent of the moneys required for the cost of instruction at Fort Lewis college as determined by the department of higher education. (2) Special programs may also be offered to assist Indian Native American pupils to prepare for, begin, or continue their college education at Fort Lewis college. Indian Native American pupils shall not be charged tuition for such programs. The size of any special programs offered pursuant to this subsection (2) shall be limited by the facilities and revenues available and by the level of appropriations set therefor by the general assembly. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
