Second Regular Session Sixty-seventh General Assembly STATE OF COLORADO INTRODUCED LLS NO. 10-0831.01 Jason Gelender SENATE BILL 10-145 SENATE SPONSORSHIP Romer, Williams, Bacon, Foster, Johnston, Hodge, Steadman HOUSE SPONSORSHIP McCann, Middleton, Ryden, Todd Senate Committees House Committees Transportation A BILL FOR AN ACT Concerning the alleviation of traffic congestion within the United States highway 40 corridor through central and east Denver and Aurora, and, in connection therewith, requiring the high-performance transportation enterprise to study the feasibility of entering into a public-private partnership to develop, construct, and operate a rail fixed guideway system between the Auraria higher education center and the Anschutz medical campus of the university of Colorado at Denver and, if a special district or improvement district is subsequently formed for the purpose of financing, developing, constructing, and operating such a system, requiring a specified portion of the road safety surcharge paid by vehicle owners who reside within one mile of the system route to be paid to the special district. The bill requires the high-performance transportation enterprise to study the feasibility of entering into a public-private partnership to develop, construct, and operate a rail fixed guideway system between the Auraria higher education center and the Anschutz medical campus of the university of Colorado at Denver. If, after the study is completed, a special district is formed for the purpose of financing, developing, constructing, and operating such a system, the bill requires $4 of each road safety surcharge paid by vehicle owners who reside within one mile of the system route to be paid to the special district. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 43-4-806, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 43-4-806. High-performance transportation enterprise - creation - board - funds - powers and duties - limitations - reporting requirements - highway 40 corridor feasibility study - legislative declaration. (11) (a) As a possible means of applying transportation demand management principles to the problem of traffic congestion within the United States highway 40 corridor through central and east Denver and Aurora, the transportation enterprise shall study the feasibility of entering into a public-private partnership to develop, construct, and operate a rail fixed guideway system, as defined in section 40-18-101 (3), C.R.S., between the Auraria higher education center and the Anschutz medical campus of the university of Colorado at Denver. (b) Notwithstanding the provisions of sections 43-4-804 (1) and 43-4-205 (6.3), if, after the transportation enterprise completes the feasibility study required by paragraph (a) of this subsection (11), a special district or improvement district of any kind is formed for the purpose of financing, developing, constructing, and operating a rail fixed guideway system between the Auraria higher education center and the Anschutz medical campus of the university of Colorado at Denver, four dollars from each road safety surcharge imposed pursuant to section 43-4-804 (1) and collected upon the registration of a vehicle registered to a person at an address that is within one mile of the system route shall be allocated to the special district or improvement district. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
