HOUSE BILL 10-1399 BY REPRESENTATIVE(S) Weissmann, Labuda, Todd; also SENATOR(S) Gibbs, Newell. Concerning the authority of the Colorado bureau of investigation to assist a chief of a fire department in the investigation of a fire related to the crime of arson. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 24-33.5-412 (1) (r), Colorado Revised Statutes, is amended, and the said 24-33.5-412 (1) is further amended BY THE ADDITION OF A NEW PARAGRAPH, to read: 24-33.5-412. Functions of bureau - legislative review. (1) The bureau has the following authority: (r) To conduct criminal history records checks pursuant to section 24-72-305.3; and (s) When requested by the chief of a fire department or his or her designee, and approved by the director or his or her designee, the bureau may assist in the investigation of a possible crime related to arson. When such a request is made by a fire department, the fire department shall notify the appropriate law enforcement agency that a request for assistance from the bureau has been made. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety. ________________________________________________________ Terrance D.
