In 2009, the governor issued an executive order to create a web-based system that allows public access to government revenue and expenditures data, which system is commonly known as the "Transparency Online Project". The web-based system was modified by law, which included authority for the chief information officer to aggregate information in the system. The bill eliminates the chief information officer's ability to aggregate information and, instead, specifically requires the data in the web-based system to be a replicate of the most specific, nonconfidential data available in the state financial system database. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 24-72.4-102, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 24-72.4-102. Definitions. As used in this article, unless the context otherwise requires: (1.5) "State financial system database" means the database commonly known as the financial data warehouse, created by the office of information technology on behalf of the state controller pursuant to the authority set forth in section 24-30-202. SECTION 2. The introductory portion to 24-72.4-103 (1) and 24-72.4-103 (1) (a), Colorado Revised Statutes, are amended to read: 24-72.4-103. Web-based system - enhancements. (1) No later than January 1, 2010, The chief information officer shall modify the web-based system to meet the following requirements: (a) Except as set forth in paragraph (g) of this subsection (1), the state expenditures and revenues data included in the web-based system shall be a replicate of the expenditure and revenue data included in the state financial system database commonly known as the financial data warehouse, created by the office of information technology on behalf of the state controller pursuant to the authority set forth in section 24-30-202; except that, regardless of the form of the data in the financial data warehouse, where access to each individual transaction is likely to hinder, rather than foster, the goal of accountability and transparency, the system may provide access to aggregated information at the most specific level at which such data is available in a machine-readable format; SECTION 3. Act subject to petition - specified effective date. This act shall take effect September 1, 2010; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within the ninety-day period after final adjournment of the general assembly, then the act, item, section, or part shall not take effect unless approved by the people at the general election to be held in November 2010 and shall take effect on the date of the official declaration of the vote thereon by the governor.
