SENATE BILL 10-208 BY SENATOR(S) Keller, Boyd, Carroll M., Foster, Gibbs, Hodge, Hudak, Newell, Tochtrop, Williams; also REPRESENTATIVE(S) Acree, Gerou, Kerr J., Nikkel, Priola, Schafer S., Todd. Concerning repealing references to the referral and placement committee to reflect current usage of interdisciplinary teams in developing individualized plans for persons with developmental disabilities. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Repeal. 27-10.5-102 (26), Colorado Revised Statutes, is repealed as follows: 27-10.5-102. Definitions. As used in this article, unless the context otherwise requires: (26) "Referral and placement committee" means an interdisciplinary or interagency committee authorized by a community centered board or the department to make referral and placement recommendations for persons receiving services. SECTION 2. 27-10.5-103 (2) (e), Colorado Revised Statutes, is amended to read: 27-10.5-103. Duties of the executive director - rules. (2) The department shall adopt such rules, in accordance with section 24-4-103, C.R.S., as are necessary to carry out the provisions and purposes of this article, including but not limited to the following subjects: (e) Eligibility determination, and the criteria for determination, and admission to programs, and the functions of the referral and placement committees the program; SECTION 3. Repeal. 27-10.5-105 (2) (f), Colorado Revised Statutes, is repealed as follows: 27-10.5-105. Community centered boards - designation - purchase of services and supports by community centered boards. (2) Once a community centered board has been designated pursuant to this section, it shall, subject to available appropriations: (f) Establish a referral and placement committee, in conformance with department rules, to provide recommendations on placement for persons receiving services and access to programs based on identified eligibility criteria; SECTION 4. Safety clause.
