HOUSE BILL 10-1209 BY REPRESENTATIVE(S) Balmer, Casso, Court, Gardner B., Gerou, Kefalas, Looper, Nikkel, Summers, Swalm, Todd, Carroll T.; also SENATOR(S) Gibbs, Tochtrop. Concerning authorization to place voluntarily an identifier of a branch of the United States armed forces on certain identification documents issued by the department of revenue, and making an appropriation therefor. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 42-2-114, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 42-2-114. License issued - fees - repeal. (10) (a) At the applicant's voluntary request, the department shall issue a driver's license bearing an identifier of a branch of the United States armed forces, such as "Marine Corps", "Navy", "Army", "Air Force", or "Coast Guard", if the applicant possesses a currently valid military identification document, a DD214 form issued by the United States government, or any other document accepted by the department that demonstrates that the applicant is an active member or a veteran of the branch of service that the applicant has requested be placed on the driver's license. The applicant shall not be required to provide documentation that the applicant is an active member or a veteran of a branch of the United States armed forces to renew or be reissued a driver's license bearing an identifier issued pursuant to this subsection (10). The department shall not place more than one branch of the United States armed forces identifier on an applicant's driver's license. (b) (I) To be issued a driver's license bearing a branch of service identifier, or to have such license renewed, the applicant shall pay a fee of fifteen dollars to the department, which shall be in addition to any other fee for a driver's license. The department shall transfer the fee to the state treasurer, who shall credit the fee to the highway users tax fund, except as provided in subparagraph (II) of this paragraph (b). (II) (A) The department may retain up to ninety-eight thousand five hundred thirty-eight dollars of the fees collected pursuant to subparagraph (I) of this paragraph (b) as necessary to offset the direct and indirect cost of implementing this subsection (10). (B) This subparagraph (II) is repealed effective July 1, 2012. (c) (I) This subsection (10) is effective January 1, 2011. (II) This paragraph (c) is repealed, effective July 1, 2011. SECTION 2. 42-2-303, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 42-2-303. Contents of identification card. (4) (a) At the applicant's voluntary request, the department shall issue an identification card bearing an identifier of a branch of the United States armed forces, such as "Marine Corps", "Navy", "Army", "Air Force", or "Coast Guard", if the applicant possesses a currently valid military identification document, a DD214 form issued by the United States government, or any other document accepted by the department that demonstrates that the applicant is an active member or a veteran of the branch of service that the applicant has requested be placed on the identification card. (II) This paragraph (c) is repealed, effective July 1, 2011. SECTION 3. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the highway users tax fund created in section 43-4-201 (1) (a), Colorado Revised Statutes, not otherwise appropriated, to the department of revenue, for allocation to the division of motor vehicles, driver and vehicle services, for the fiscal year beginning July 1, 2010, the sum of eighty-three thousand eighty-eight dollars ($83,088) cash funds, or so much thereof as may be necessary, for the implementation of this act. SECTION 4. Specified effective date - applicability. This act shall take effect July 1, 2010, and shall apply to driver's licenses and identification cards issued on or after said date. SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety. ________________________________________________________ Terrance D.
