Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Directs the state auditor to submit an annual report to the local government committees of the house of representatives and the senate on any legislation enacted in that year that imposes unfunded mandates on local governments. Specifies the contents of the report. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 29-1-304.5, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 29-1-304.5. State mandates - prohibition - exception - report. (2.5) (a) On or before September 1, 2009, and on or before September 1 of each year thereafter, the state auditor shall submit a report to the local government committees of the house of representatives and the senate, or any successor committees, on any legislation enacted by the general assembly during that particular year that imposes an unfunded state mandate on a local government. (b) The report shall include but not necessarily be limited to: (I) Identification of the type of local government and local government agency or official to whom the mandate is directed; (II) Whether or not an identifiable local direct cost is necessitated by the mandate and the estimated annual amount; (III) The extent of state financial participation, if any, in meeting identifiable costs; (IV) The state agency, if any, charged with supervising the implementation of the mandate; and (V) A brief description of the mandate and a citation of its origin in statute or regulation. SECTION 2. 2-3-103, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 2-3-103. Duties of state auditor. (9) The state auditor shall submit an annual report to the local government committees of the house of representatives and the senate, or any successor committees, on unfunded state mandates on local governments as provided in section 29-1-304.5 (2.5), C.R.S. SECTION 3. Act subject to petition - effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution, (August 4, 2009, if adjournment sine die is on May 6, 2009); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
