First Regular Session Sixty-seventh General Assembly STATE OF COLORADO CORRECTED INTRODUCED LLS NO. 09-0044.02 Thomas Morris SENATE BILL 09-004 SENATE SPONSORSHIP Brophy, HOUSE SPONSORSHIP Bradford, Senate Committees House Committees State, Veterans & Military Affairs A BILL FOR AN ACT Concerning a moratorium on the implementation of rules promulgated by the Colorado oil and gas conservation commission pursuant to bills enacted after May 28, 2007. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Specifies that rules of the Colorado oil and gas conservation commission concerning permit review, public health and safety, and wildlife shall not take effect prior to July 1, 2010. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 34-60-106 (11) (b) (I), Colorado Revised Statutes, is amended to read: 34-60-106. Additional powers of the commission - rules - repeal. (11) (b) (I) The general assembly shall review the rules promulgated pursuant to paragraph (a) of this subsection (11) acting by bill pursuant to section 24-4-103, C.R.S., and reserves the right to alter or repeal such rules. Any rules adopted by the commission pursuant to paragraph (a) of this subsection (11) prior to the effective date of this subparagraph (I), as amended, shall be suspended and shall not take effect until July 1, 2010. Any rules adopted by the commission pursuant to paragraph (a) of this subsection (11) on or after the effective date of this paragraph (b), as amended, shall not take effect prior to July 1, 2010. SECTION 2. The introductory portion to 34-60-128 (3) (d), Colorado Revised Statutes, is amended to read: 34-60-128. Habitat stewardship - rules. (3) In order to minimize adverse impacts to wildlife resources, the commission shall: (d) Promulgate rules by July 16, 2008, in consultation with the wildlife commission, to establish standards for minimizing adverse impacts to wildlife resources affected by oil and gas operations and to ensure the proper reclamation of wildlife habitat during and following such operations. Any rules adopted by the commission pursuant to this paragraph (d) prior to the effective date of the introductory portion to this paragraph (d), as amended, shall be suspended and shall not take effect until July 1, 2010. Any rules adopted by the commission pursuant to this paragraph (d) on or after the effective date of the introductory portion to this paragraph (d), as amended, shall not take effect prior to July 1, 2010. At a minimum, the rules shall address: SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
