Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Prohibits the board of commissioners and the manager of the Colorado state fair authority from promulgating a rule or enforcing a policy or practice that requires an exhibitor showing an animal at the Colorado state fair and industrial exposition to participate in the national animal identification system, or its successor system. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 35-65-401 (9) (j), Colorado Revised Statutes, is amended to read: 35-65-401. Colorado state fair authority - creation - board - powers and duties. (9) The board shall: (j) Adopt rules in accordance with the provisions of article 4 of title 24, C.R.S.; except that the board shall not adopt a rule, nor enforce any policy or practice of its own or of the manager of the state fair authority, that requires an exhibitor showing an animal at the Colorado state fair and industrial exposition to participate in the national animal identification system administered by the United States department of agriculture, or its successor system; SECTION 2. Effective date - applicability. (1) This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution, (August 6, 2008, if adjournment sine die is on May 7, 2008); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor. (2) The provisions of this act shall apply to exhibitors showing animals at the Colorado state fair and industrial exposition on or after the applicable effective date of this act.
