SENATE SPONSORSHIP Boyd, House Committees Senate Committees Judiciary A BILL FOR AN ACT Concerning criminalizing the possession of graffiti tools. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Creates the crime of possession of graffiti tools. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Part 5 of article 4 of title 18, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 18-4-510.5. Possession of graffiti tools. (1) A person commits possession of graffiti tools if he or she possesses a tool, instrument, or other article adapted, designed, or commonly used to commit or to facilitate the commission of an offense involving defacing public or private property and intends to use the thing possessed, or knows that another person intends to use the thing possessed, in commission of the offense. (2) Possession of graffiti tools is a class 2 misdemeanor. SECTION 2. Effective date - applicability. This act shall take effect July 1, 2008, and shall apply to offenses committed on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
