      HOUSE BILL 07-1045

      also SENATOR(S) Keller.
      
      
      Concerning an increase in the maximum number of persons who
           may serve on a county planning commission.
      
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  30-28-103 (1), Colorado Revised Statutes, is amended
      to read:
      
           30-28-103.  County planning commission.  (1)  Except as
      otherwise provided in this subsection (1), the board of county
      commissioners of any county within the state is authorized to appoint a
      commission of not less than three and not more than nine members, to be
      known as the county planning commission; except that, in counties of the
      state having a population of fifteen thousand or less desiring to establish a
      commission, the board of county commissioners may constitute the
      commission, or the board of county commissioners may appoint a separate
      body to serve as the county planning commission.  In counties of the
      state having a population of one hundred thousand or more, the
      board of county commissioners is authorized to appoint a
      commission of not less than three and not more than fifteen
      members.
      
           SECTION 2.  Effective date.  This act shall take effect at 12:01
      a.m. on the day following the expiration of the ninety-day period after final
      adjournment of the general assembly that is allowed for submitting a
      referendum petition pursuant to article V, section 1 (3) of the state
      constitution, (August 8, 2007, if adjournment sine die is on May 9, 2007);
      except that, if a referendum petition is filed against this act or an item,
      section, or part of this act within such period, then the act, item, section, or
      part, if approved by the people, shall take effect on the date of the official
      declaration of the vote thereon by proclamation of the governor.
