Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Requires the board of a water conservancy district to exclude lands from the district if such lands have not received services from the district for a period of one year prior to the date of the petition or if such lands are included within a separate water conservancy district formed under this article. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 37-45-137 (1) (d), Colorado Revised Statutes, is amended to read: 37-45-137. Exclusion of lands. (1) (d) (I) If the board deems it not for the best interest of the district that the lands mentioned in the petition or some portion thereof are excluded from the district, the board shall order that said petition be denied. but, (II) If the board deems it for the best interest of the district that the lands mentioned in the petition, or some portion thereof, be excluded from the district and, if there are no outstanding bonds of the district, the board may order the lands mentioned in the petition, or some portion thereof, to be excluded from the district. (III) The board shall order the lands mentioned in the petition or some portion thereof be excluded from a subdistrict providing augmentation for wells if the owner of such lands or a portion thereof: (A) Has tributary wells, all of which have been abandoned; (B) Has met all post-pumping depletion obligations; and (C) Receives water services from another water provider. (IV) If such an exclusion is granted pursuant to this paragraph (d) at the request of a proposed new district, it shall be conditioned to take effect only upon the legal creation of the proposed new district. SECTION 2. Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution, (August 8, 2007, if adjournment sine die is on May 9, 2007); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
