Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Prohibits a rail carrier from blocking motor vehicle traffic at a grade crossing for more than 10 minutes unless the train cannot be moved for reasons beyond the control of the rail carrier. Requires train movements to be separated in time by at least 5 minutes or until previously blocked traffic has been cleared, whichever comes first. Punishes violations by a fine of $500 to $1,100. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Article 28 of title 40, Colorado Revised Statutes, is RECREATED AND REENACTED, WITH AMENDMENTS, to read: ARTICLE 28 Crossings 40-28-101. Grade crossings - time limits on blockage of motor vehicle traffic. (1) A railroad corporation shall not permit any train, railroad car, or engine to obstruct public travel at a railroad-highway grade crossing for a period in excess of ten minutes unless such train, railroad car, or engine cannot be moved by reason of circumstances over which the railroad corporation has no control. (2) A railroad corporation shall not permit successive train movements to obstruct vehicular traffic at a railroad-highway grade crossing until either: (a) All vehicular traffic previously delayed by such train movements has been cleared; or (b) If all such traffic has not been cleared, a period of at least five minutes has elapsed between train movements. 40-28-102. Violation - penalty. An engineer, conductor, or other person having charge of and running any train, railroad car, or engine upon a railroad who violates section 40-28-101 commits a misdemeanor and shall be punished by a fine of not less than five hundred dollars nor more than one thousand one hundred dollars. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
