Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Prior to applying for parole, requires an inmate who is eligible for parole to sign an agreement subjecting himself or herself to search or seizure by a parole officer, police officer, sheriff, or Colorado state patrol officer. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Part 4 of article 22.5 of title 17, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 17-22.5-404.5. Consent to search. (1) Prior to applying for parole, an inmate who is eligible for release on parole pursuant to this part 4 shall agree in writing to be subject to search or seizure while on parole by a parole officer, police officer, sheriff, undersheriff, deputy sheriff, or Colorado state patrol officer at any time, day or night, with or without a search warrant, and with or without cause. (2) It is not the intent of the general assembly to authorize law enforcement officers to conduct searches or seizures for the sole purpose of harassment. SECTION 2. Effective date - applicability. This act shall take effect July 1, 2007, and shall apply to inmates applying for parole on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
