06:53 PM -- Senate Bill 05-206

Representative White, prime sponsor, introduced Senate Bill 05-206 regarding the conduct of elections. This measure offers a variety of changes to election rules, including;

• a voter-verifiable paper record of all votes;
• sets regulations for voter registration drives;
• modifies the law governing provisional ballots;
• requires local election officials to be trained and certified by the Secretary of State;
• revisers the election calendar;
• adds three new types of identification that may be shown to vote; and
• allows emergency voter registration.

Representative White provided Attachment A, Senate Amendments to SB 05-206 - Fact Sheet, and Attachment B, SB 05-206 FACT SHEET.

Don Quick, Blue Ribbon Election Panel, testified in support of the bill. He was joined at the table by Donetta Davidson, Colorado Secretary of State, testified in support of the bill. They responded to committee questions. Ms. Davidson provided Attachments D, Voter ID States That Allow Student ID, and E, Colorado - Voter Registration Application. Both witnesses testified on the training to assist volunteers to register voters.

Carol Snyder, representing the Colorado County Clerks Association, and Scott Doyle, also representing the Colorado County Clerks Association, testified in support of the bill. Ms. Snyder indicated that they were basically present to respond to committee questions. She indicated that there are several amendments to the bill and she commented on the amendments to the bill that they were aware of, including, for a public test of the system, and the public notice for testing the system. They responded to committee questions. There was further discussion concerning absentee ballots, and the counting of those ballots.

08:47 PM -- Senate Bill 05-199

Representative Coleman, prime sponsor, introduced Senate Bill 05-199 which makes changes tot he laws governing the Secretary of State's (SOS) regulation of the games of chance, including bingo and raffles. The bill requires the SOS to accept electronic filings of documents, without the need to furnish a physical, original document, after July 1, 2006. She responded to committee questions.

Marc Rosen, representing the Helping Hands for the Homeless (HHH), testified in opposition to the bill. He explained what he signed up to do as a games manager when he first volunteered his services and took his oath. He explained that this bill would endorse the games managers so that they would have liability. Mr. Rosen stated that he is a volunteer, not an employee of HHH. He, and Representative Coleman, responded to committee questions.

James Nichol, representing the Empire Elks Lodge, testified in opposition to the bill. He asked that this bill be reconsidered, and brought back next year, with a less adversarial tone. He also stated that he believes bingo should be under the guidance of the Department of Revenue, and not the Secretary of State's Office. He responded to committee questions. Representative Coleman indicated that this bill has been on the calendar for some time, so, she believes that the issues related to the bill have been out there to discuss. Mr. Nichol stated that he believes there has been a lack of communication on the issues related to this bill.

Angie Wood, representing a bingo hall, Winners Bingo, testified in opposition to the bill. She noted that she has volunteered for nonprofits for 14 years, and now manages a bingo hall. She had several issues with the bill, including the fact that advertising for bingo is proposed to come out of the hall's general fund. She indicated that she would like to see more detail in the bill, and continued to comment on various provisions in the bill.

Michael Shea, representing the SOS's office, Director of Licensing and Enforcement, provided clarification on previous testimony for the committee. He also responded to committee questions and commented on various provisions of the bill.

Representative Coleman stated that she shared Rep. Cadman's concern over the letter from the SOS to the games manager or bingo hall which requests their records for an audit, which does not appear to provide enough time for the games of chance to provide such records.

Representative Weissmann discussed potential issues and amendments that had been raised by the testimony. Representative Coleman said that she has shared concerns about the bill and about the process before this evening.
She said that there were a lot involved in the regulation of bingo and games of chance.

Representative Coleman described some of the background work that Representative Crane had done before she and Senator Takis had introduced the bill. Representative Crane made further comments about the addressing the issues in the bingo industry.

10:10 PM -- Senate Bill 05-223

Representative Rose, prime sponsor, explained Senate Bill 05-223, which creates the Consolidated Communications Network Authority. The measure defines the authority's membership as the following entities that would use the digital trunked radio network as their primary means of wireless voice communication; law enforcement agencies and fire departments; schools; agencies of a city, county or city and county; agencies of an Indian tribe; federal and state agencies; and persons or entities eligible to hold an authorization in the public safety radio pool pursuant to rule so the Federal Communications Commission. He discussed the impact of the provisions of the bill on providers and entities that use the statewide.

10:42 PM -- House Bill 05-1352

Representative Coleman, prime sponsor, introduced House Bill 05-1352, concerning the security of communication and information resource in public agencies. Rep. Weissmann stated that the bill is on the table for testimony and discussion only. Action on the bill will take place at a later date, once the fiscal note has been completed, and possibly on the House floor at the microphone. She indicated that Henry Sobanet, of the Office of State Planning and Budget, as well as others, have worked with her on the bill. She responded to committee questions.
