Representative May, prime sponsor, introduced Senate Bill 05-166 regarding the failure to use a restraining device by occupants in motor vehicles driven by person under 20 years of age. The bill expands the requirement that occupants must use these devices in motor vehicles driven by persons 17 years of age to include persons under 20 years of age. He responded to committee questions.

04:05 PM -- House Bill 05-1321

Representative Rose, prime sponsor, explained House Bill 05-1321 concerning the enforcement of prohibiting drivers from overtaking a school bus receiving or discharging passengers. A bus driver who is reporting such a violation would not be required to provide information that the bus driver has not observed. He responded to committee questions concerning whether this was a duplication of current law. Rep. Rose stated that this a technical change that will help with the enforcement of current law. He believes that the intent of this bill is to protect children getting on and off of school buses while educating school bus drivers and others about such a crime or violation.

04:19 PM -- Senate Bill 05-097

Representative Sullivan, prime sponsor, introduced Senate Bill 05-097 which authorizes a public highway authority to create an administrative toll enforcement process at the request of the judicial department.

Jerry Marroney, representing the Colorado Judicial Department, testified in support of this bill. He noted that the department looked at similar legislation from several other states before deciding upon this bill. He reviewed various provisions of the bill, and explained that the department had worked with the Division of Motor Vehicle to have the bill drafted. He responded to committee questions.

Scott Spendlove, representing the E-470 Public Highway Authority and the Northwest Parkway Public Authority, testified in support of the bill. He explained that representatives from both highway authorities are in support of the bill, but couldn't be present today. Mr. Spendlove explained what the bill would do to enforce toll evasion violations.

Representative Pommer, prime sponsor, introduced Senate Bill 05-082 which creates the Colorado "Kids First" license plate for motor vehicles that do not exceed 16,000 pounds. It authorizes the issuance of the plate to motorists who pay the appropriate one-time fee of $25 and who have a certificate issued by the Rocky Mountain Research and Prevention Institute. He provided Attachment C, a fact sheet entitled Colorado Kids 1st License Plate Initiative Fact Sheet.
