Representative Kerr presented HB05-1328 which updates specifications and measures of fuels to be consistent with current national standards. He pointed out for the committee that a proposed strike-below amendment, amendment L.001 (Attachment A), replaces the bill.

Stan Dempsey, representing the Colorado-Wyoming Petroleum Marketing Association, testified in support of the bill. Mr. Dempsey testified that the bill addresses compliance issues that have arisen recently between refiners and wholesale sellers of fuels. Mr. Dempsey responded to questions from the committee.

Dick Piper, representing the Department of Labor and Employment, Division of Oil and Public Safety, provided the committee with an overview of the bill. Standard specifications and measures of fuels have changed over recent years. The bill brings references to those standards in statute up to date. Mr. Piper responded to questions from the committee.

11:55 AM -- Senate Bill 05-013

Representative Marshall presented SB05-013 which requires individuals applying for renewal of real estate broker or salesperson licenses to first submit fingerprints and a fee to the Colorado Bureau of Investigation for a background check. This requirement is effective for three years to assure that background checks are completed for each broker or salesperson. Renewed licenses are effective for three years so each applicant is required to have one check. Persons maintaining an inactive license are not required to submit fingerprints for a background check.

Carol Richmond, representing the Colorado Association of Realtors, testified in favor of the bill. Ms. Richmond testified that there is a loophole in the current system that makes fingerprints recorded prior to three years ago unavailable.

12:13 PM -- Senate Bill 05-137

Representative Paccione presented SB05-137 which allows consumers to request that credit reporting agencies place, temporarily lift, and remove a security freeze on the consumer's credit report. Representative Paccione handed out information on identity theft victim complaint data (Attachment B). She also presented amendment L.030 (Attachment C) to the committee.

Bob Oblock, representing himself as a private investigator, testified in opposition to the bill. Mr. Oblock testified that persons in his profession need access to credit information that would be unavailable under this bill. Mr. Oblock responded to questions from the committee.

Anthony Mastin, representing himself as a private investigator, testified in opposition to the bill. Mr. Mastin testified that costs associated with notifications required by the bill will be borne by consumers.

Edward O'Connor, representing himself as a private investigator, testified in opposition to the bill.

Terry Faulke, representing himself as a private investigator and the Retired Peace Officers of Colorado, testified in opposition to the bill. Mr. Faulke would like to see an exception in the bill for private investigators to be able to access credit information. Representative Marshall asked Mr. Faulke how private investigators are regulated in Colorado. Mr. Faulke responded that they are not regulated. Representative Marshall expressed her concern with exempting them since anyone could pose as a private investigator.

Mike Feeley, representing the Consumer Data Industry Association, testified in favor of the bill. Mr. Feeley testified that amendment L.030 makes the statutes consistent regarding cross-references and makes changes to the original draft in order to make Colorado's legislation consistent with other states with similar laws.
