Representative Paccione, prime House sponsor, called the conference committee to order. A quorum was present. She summarized the differences between the House and Senate versions of the bill and explained what she would like to see changed, mainly that a fine of $1,000 for a first offense of minor in possession is too steep. She stated that the House was given permission to go beyond the scope of differences and that the Senate was also requesting permission to do so. Committee members were provided with Amendment CLHB1183.001 (Attachment A).

Representative Paccione explained CLHB.001. The amendment provides for a graduated sentencing scheme for conviction of minor in possession (maximum fine of $250 for a first offense, $500 for a second offense, and $1,000 for a third or subsequent offense). The committee discussed the extent to which courts impose a maximum sentence, members' preferences for giving judges discretion in sentencing for this offense, the extent to which parents or the underage offenders will be paying the prescribed fines, and penalties other than fines imposed by a court for possession of alcohol by a minor. Representative Paccione said that the amendment also clarifies language in the safe haven provision so that a total of three people can obtain immunity. Representative Paccione then suggested amending page 4, line 13 of the rerevised bill, which links immunity to cooperation with law enforcement officials, by limiting language to medical assistance only. Committee discussion ensued regarding this change; the purpose of immunity; teenagers' knowledge of the law in this area; limiting immunity to two people instead of three; and the need for persons on the scene to stay at the scene, seek necessary medical assistance, and cooperate with any kind of investigation.
