The meeting was called to order by the chairman, Representative Merrifield. Representative Merrifield announced that he would lay over Senate Bill 05-51 until the following Thursday, March 10.

Representative Witwer reviewed the provisions of Senate Bill 05-158, concerning in-state tuition status for Coloradans who were members of the military. He described the criteria the bill set up for tuition status for members of the military who are no longer on active status. Representative Witwer responded to questions about an amendment made in the Senate involving "may" and "shall."

Committee discussion continued on the issue of those members of the military on permanent change-of-station basis and those who have been discharged from the military.

Sandy Calhoun, Director of Student Financial Services for Colorado State University, testified in favor of the bill. She said that the bill would impact a relatively few number of students, but that it is an important issue for those students. She spoke about examples of students who had lived in Colorado for a long period of time before leaving Colorado for military service. She responded to questions from committee members about in-state tuition status.

The committee discussed amending the bill. Ms. Calhoun returned to the table to respond to final questions about the language in the bill. Committee discussion continued.

Representative King moved (Second: Rose) to amend page 2, line 14, strike "MAY" and substitute "SHALL" (see vote below). The committee discussed the proposed amendment.


1:59 PM

Michele Hanigsberg, Office of Legislative Legal Services, came to the table to respond to additional questions about the amendment made in the Senate. The committee continued to discuss issues around establishing domicile.

02:07 PM

Representative Witwer made additional comments about the applicability of the statutory section to active service members of the military. The committee discussed the policy decision regarding extending of in-state tuition status to all members of the military.

Representative Witwer continued his comments about the proposed amendment.
