11:20 AM -- House Bill 05-1219

Representative Curry, sponsor, described the provision of HB05-1219 concerning the protection of the rights of surface owners from oil and gas operations. She also summarized prior committee testimony on the bill and described the provisions of Amendment L. 016 (Attachment A). A pre-amended draft of the introduced bill was distributed that includes Amendment L. 016 (Attachment B). Representative Curry explained that the Article II, Section 14 of the Colorado Constitution limits the taking of private property for private use

There was no testimony on the bill. The committee heard testimony on HB05-1219 on February 14 and 16, and on Mach 16, the committee received a briefing from the Colorado Oil and Gas Conservation Commission on the regulation of surface damages from oil and gas development.



Scott Campbell, representing himself, submitted a letter of opposition to the bill (Attachment C).
