02:07 PM -- Senate Bill 05-022

Representative Boyd introduced Senate Bill 05-022. She explained that the bill creates a pharmacy and therapeutics committee to evaluate and make recommendations to the State Medical Services Board regarding which drugs should be included on a Medicaid preferred drug list (PDL). She explained the membership of the pharmacy and therapeutics committee. She described the categories of drugs that will be excluded from the preferred drug list. She responded to questions from the committee. A number of amendments were distributed to the committee, L.19, L.20, L.21, L.24, L.25, L.26, L.27, L.29, L.30, L.31, L.32, L.33, L.34, L.35, L.36, L.38, L.39, L.40, L.41, L.42, L.43, L.44, and L.45 (Attachments E through AA). The chairman announced that both the proponents and opponents of the bill would be allowed one hour for testimony and questions from the committee.

Mike McGuire, AARP, testified in support of the bill. He testified that an evidence-based preferred drug list is provider and consumer-friendly. He testified that the bill will identify medications that are the most effective and that have the fewest side effects. He stated that the bill provides incentives to prescribe cost-effective and safe drugs. He discussed the cost savings as a result of passing the bill.

Alan Eisenberg, AARP, testified in support of the bill. He stated that doctors already collaborate with other professionals to identify effective and lower cost medications. He stated that an evidenced-based drug list will provide a greater continuity of care and cost-containment. Mr. Eisenberg and Mr. McGuire responded to questions from the committee.

Jane Crow, citizen, testified in support of the bill. She responded to questions from the committee.

Mark Kinney, Rx Plus Pharmacies and Colorado Pharmacists Society, testified that a preferred drug list will result in cost savings for the state Medicaid program. He responded to questions from the committee.

Carrie Lucas, Colorado Cross Disability Coalition, testified in opposition to the bill. She testified regarding her personal experiences seeking medication through the Medicaid program. She responded to questions from the committee. She stated that the current prior authorization should be revised before more drugs are made subject to prior authorization.

Kathy Pendland, citizen, testified in opposition to the bill and regarding her experiences as a Medicaid recipient.

Dr. Barry Martin, Organization of Community-centered Boards, testified that he has concerns with the implementation of the preferred drug list, given the state's experience with Medicaid prior authorization and the Colorado Benefits Management System. He testified that the preferred drug list will affect persons with developmental disabilities, and that sometimes, it is difficult to find appropriate medications for persons with developmental disabilities. He responded to questions from the committee.

Dr. Alan Schockett, Adventist Pharmaceutical Company, testified that formularies and prior authorization may cause barriers to health care that may increase health care costs. He stated that these increased health care costs may outweigh the savings under the bill and that there have been few studies on the consequences of formularies with prior authorization. He responded to questions from the committee.

Julie Reiskin, Colorado Cross Disability Coalition, testified in opposition to the bill. She spoke regarding the categories of Medicaid recipients who will be affected by the bill. She stated that costs of other services of the Colorado Medicaid program are growing faster than prescription drug costs. She responded to questions from the committee. She distributed a handout to the committee. A copy was not provided to staff.

Catherine Benavidez Clayton, Colorado Hispanic Nurses and Colorado Council of Black Nurses, deferred to the testimony of Adrienne Benavidez.

Adrienne Benavidez, Color of Justice Inc., testified regarding pharmacist reimbursement in the bill and other portions of the bill. She requested that the bill be amended to exclude other categories of drugs from the preferred drug list.

Fred Acosta, National Alliance for the Mentally Ill, testified regarding studies that identify difficulties with the prior authorization process in other states.

Mark Simon, citizen, testified in opposition to the bill and regarding his experiences as a Medicaid recipient. He stated that data regarding preferred drug lists are developed by studying persons with only one, not multiple, illnesses or conditions. He distributed a handout to the committee (Attachment CC ).

David Gross, AARP, testified that some members of AARP are Medicaid recipients. He stated that his organization doesn't support paying for high cost medications that may have no or little value when vulnerable populations are being cut from Medicaid.

Dr. Bob McCartney, Colorado Medical Society, testified in support of the bill. He stated that there are only two utilization methods to contain pharmaceutical costs in Medicaid: prior authorization and a formulary. He testified that, by itself, the use of prior authorization can be onerous. He testified that a preferred drug list simplifies the prescription of drugs for Medicaid patients.
