07:34 AM -- House Bill 05-1335 - Concerning an Exemption for Biodiesel Fuel

Representative Hodge, prime sponsor, explained the provisions of the bill. Representative Hodge commented that House Bill 05-1335 exempts biodiesel fuel from the state special fuel tax for 10 years, from 2006 through 2015. The exemption includes biodiesel fuel mixed with petroleum-based diesel fuel. The bill defines "biodiesel fuel" as a diesel fuel substitute produced from nonpetroleum renewable resources that meets the registration requirements for fuels and fuel additives established by the Environmental Protection Agency under the federal "Clean Air Act". After a brief discussion, Representative Hodge distributed amendment L.001 (Attachment A) and explained that the amendment reduces the exemption from 10 to 2 years.

The following persons testified:

07:35 AM -- Mr. Jeff Probst, Biodiesel Tax Incentive, testified in support of the legislation and commented that House Bill 05-1335 can work to reduce toxic emissions and provide a long-term environmental benefit for the state.
