10:31 AM -- Senate Bill 12-007

Representative Vaad, chair, called the meeting to order. A quorum was present. Representative Hamner, prime sponsor, presented Senate Bill 12-007. The bill is recommended by the Transportation Legislation Review Committee (TLRC). It alters the procedure for creating group special license plates. Specifically, the bill:

• removes the requirement that an applicant certify that at least 3,000 plates will be issued within one year;
• allows special license plates to be sold until inventories are depleted; and
• removes the requirement that proof of membership be provided to obtain certain license plates.

Representative Hamner discussed the provisions of the bill and distributed handouts to the committee (Attachments A and B). Representative Brown commented on taxpayer funds related to license plates.

Ms. Maren Rubino, representing the Department of Revenue (DOR), came to the table to respond to questions from the committee concerning Attachment A, which contain DOR suggestions concerning the special group license plate procedure. Representative Ramirez asked for information about non-profit organizations that provide a bond in order to create a license plate. Representative Tyler asked about the funds received by the state from group special license plates. Ms. Rubino said that several million dollars are generated from special license plates that are deposited into the Highway Users Tax Fund (HUTF). Representative Brown asked about monies generated by special license plates. Committee discussion ensued concerning special license plates.

Ms. Rubino said that approximately $5 million is deposited annually to HUTF and $2 million is deposited annually to the License Plate Cash Fund from special license plate revenues.

Representative Hamner discussed a proposed conceptual amendment to the bill. Representative Vaad commented that he is going to be proposing a conceptual amendment.

Mr. Jery Payne, representing the Office of Legislative Legal Services, came to the table. He informed the committee that the amendment Representative Vaad referred to is currently being drafted.

Representative Brown commented on adding a requirement that a non-profit provide a bond in order to create a special license plate. Representative Scott asked if adding a provision concerning a bond requirement would need to be addressed in a separate bill. Representative Hamner said that the TLRC did not have consensus on the bond issue. She commented that adding a bond requirement is more than a conceptual amendment.

Ms. Rubino came back to the table. Representative Vaad commented on the bond issue. Ms. Rubino said that the DOR is trying to develop a system, with the Department of Corrections, where license plates would be printed on demand. Representative Brown spoke on the bond issue.
