Rep Holbert - would allow the complaint to be elevated to the department of education and when reviewing the accreditation the CDE will determine if the school district has shown a pattern. Trying to achieve some sort of what-if scenario. if the school messes up, not looking for immediate punishment, let CDE take action.

Rep Peniston - so this doesnt say that a parent cant automatically go to the school board first. --- Rep holbert - it would allow a parent to go to the school board first if they chose to.

Rep Solano - do CASE, CASB, CDE, on board as amended.

Rep Holbert - did hear from CASB. It was his understanding that they support this bill. not sure if they have seen the amendments.

Rep Solano - feels this goes a bit far when talking about accreditation. thinks it could be handled well with the individual school boards.

Rep Hamner - big believer in local control. firmly believe in that process. to have the complaint go directly to the CDE...normally, would go directly to the teacher first. to not have the school board involved circumvents the process. and this doesnt take away the fact that a child was subjected to the survey without the parent not wanting to.

Rep Holbert - doesnt see anything in the amendment that would prevent them from going to the school district board of education to report a violation. Doesnt see any immediate punishment. Dont overlook the potential that each complaint might represent a violation of law. If there is a pattern of bahavior in a school district, thinks the CDE should be made aware of that.

Rep Kerr - nothing in the amendment prevents going to the school board first. If a parent were to hear about this...and a parent who does not read law everyday understands that they should go to the CDE directly. Rep Kerr - how many of these parental conplaints do we have statewide? Will this create a major fiscal impact? the bill says CDE will investigate all of these complaints. concerned about the burden placed on CDE.

Rep Holbert - would be friendly with a second read amendment. believes this is a rare instance. feels this is a reasonable amendment.
