Representative Vaad, chair, called the meeting order. A quorum was present. Representative Becker, prime sponsor, presented House Bill 12-1222. The bill, as recommended by the Joint Budget Committee, recreates the Department of Transportation (CDOT) Renovation Fund and specifies that it consists of the balance it had when it was repealed on July 1, 2007. This fund is continuously appropriated to the CDOT to pay for the renovation of real property and to make payments under any lease-purchase agreement authorized pursuant to House Bill 04-1456. Representative Barker discussed the provisions of the bill and responded to questions from the committee.

Representative Becker, prime sponsor, presented House Bill 12-1224. The bill, as recommended by the Joint Budget Committee, establishes the Consolidated Communications Systems Authority (CCSA), a statutory public entity representing the interests of various members that use the statewide digital trunked radio system (DTRS) as a primary means of public safety communication. Members of the CCSA include local governments, law enforcement agencies, school districts, state and federal agencies, and other entities authorized to use public safety radio communications. The CCSA is governed by a 13-member board, with five board members from local governments in various regions of the state, one at-large local government board member, one board member selected by tribal nations in the state, and six board members appointed by the governor to represent the following six state agencies:

• the Governor's Office of Information Technology (OIT);
• the Colorado State Patrol (CSP);
• the Department of Corrections (DOC);
• the Department of Transportation (CDOT);
• the Department of Natural Resources (DNR); and
• the Department of Local Affairs (DOLA).


The bill creates the Consolidated Communications Fund and provides for the deposit of member dues and subscriptions, grants, and moneys made available from the state or any other source. The CCSA is authorized to invest moneys in the fund and to expend moneys in the fund for operation and maintenance of the DTRS, improvements to the DTRS, and for the CCSA's administrative costs.

The CCSA solicits funding for the DTRS, represents its membership in strategic, technical, and regulatory matters; and advises the Governor and General Assembly regarding the present status and future needs of the DTRS. On an annual basis, the CCSA must present a written report to the Joint Budget Committee concerning the DTRS's operational and capital needs and funding options to meet those needs.

The CCSA is a successor organization to the current governance of the DTRS, and the bill provides for the transfer of each qualified current member to membership in the CCSA.

Representative Becker discussed the provisions of the bill and explained proposed amendments L.001 and L.002 (Attachments A and B, respectively).

Mr. Todd Olson, representing the Governor's Office of Information Technology (OIT), testified in support of the bill. Mr. Olson gave a brief overview of DTRS. Mr. Olson said that the initial charge of the program was to cover the major roadways in the state. Mr. Olson emphasized the success of the program and commented on the importance of sustainability. Mr. Olson said that OIT spends approximately $5.4 million to maintain the program. Representative Jones asked for more information about DTRS. Representative Brown commented on the importance of maintaining the system. Representative Williams asked about the emergency first responder system. Representative Hamner asked what the top concerns are with the system that would be solved with the establishment of authority under the bill.

The committee came back to order. Representative Jones, prime sponsor, presented House Bill 12-1166. Beginning July 1, 2012, the bill, with strike-below amendment L.001, requires state agencies, including higher education institutions, to monitor, track, and verify utility usage data for all state-assisted facilities that have achieved high performance certification. Agencies are directed to annually report utility usage data to the Office of the State Architect (OSA), within the Department of Personnel Administration. Completed facilities and those under design or construction that were required — pursuant to current law — to be designed or built to high performance certification standards are strongly encouraged, but not required, to follow the provisions of this bill. Representative Jones discussed the history behind the bill and discussed proposed amendment L.001 (Attachment G).
