01:43 PM -- Senate Bill 12-184 - Concerning Special Mobile Machinery Fleets


Representative Priola and Representative Bradford, prime sponsors, explained the provisions of the bill. Representative Bradford noted that Senate Bill 12-184 allows owners of 10 or more pieces of special mobile machinery (SMM) to register their entire fleet once per year. The committee discussed the definition of special mobile machinery. Representative Priola noted that these vehicles are commonly used in the construction, maintenance, and repair of roadways, the drilling of wells, and the digging of ditches. He closed by noting that in order to register a fleet under this bill, an owner must submit a report to the registering county clerk and the Department of Revenue, stating where the SMM was first delivered in the state, with evidence of taxes and fees paid in the preceding quarter.

Mr. Scott Meiklejohn, representing United Rentals -- Sunbelt Rentals, testified in support of the bill. Mr. Meiklejohn distributed a handout with pictures of various specialized mobile machinery (Attachment A) and a letter of support (Attachment B). Mr. Meiklejohn discussed the need for the bill. He said the fleet plate system is designed to streamline the existing system for licensing SMMs. Mr. Meiklejohn spoke to the anticipated fiscal impact of the bill on counties and SMM operators. Mr. Meiklejohn addressed questions from the committee. The committee discussion continued about the timing of the bill's introduction.

Mr. Meiklejohn responded to questions from the committee about the 25 percent fee referenced on page 3, line 9 of the introduced bill, and about the possibility of working on the bill during the 2012 legislative interim in the Transportation Legislation Review Committee (TLRC). He also responded to a question about how operators will register fleets of SMMs under the bill. Discussion turned to the multi-year impact of the bill. Mr. Meiklejohn said SB 12-184 will not change the process or cost of titling and licensing SMMs.

02:04 PM -- House Bill 12-1179 - Concerning the PERA Board of Trustees

Representative DelGrosso, Chair, explained that the committee heard initial testimony on House Bill 12-1179 on February 23, 2012. On behalf of the bill sponsor (Representative Kerr J.), Representative DelGrosso, noted that House Bill 12-1179 modifies the makeup of the 15-member voting board of trustees of the Public Employees' Retirement Association. Representative DelGrosso continued by saying that the bill sponsor had asked the committee to postpone House Bill 12-1179 indefinitely so that more research can be done on the policy issue. The committee took the following action.

02:09 PM -- Senate Bill 12-083 - Concerning Dynamic Modeling

Representative DelGrosso, prime sponsor, explained the provisions of Senate Bill 12-083. He noted that the legislation allows Legislative Council Staff to study dynamic modeling to analyze the fiscal impact of proposed legislation. The committee discussed the use of dynamic modeling and the information resulting from the analysis of certain public finance legislation.

Ms. Ali Mickelson, representing the Colorado Fiscal Policy Institute, noted that her organization took a neutral position on the legislation. Ms. Mickelson talked about the mission of the institute and other states that had experiences using a dynamic model to analyze the indirect effects of public finance legislation.
