Representative Vaad, chair, called the meeting to order. A quorum was present. Representative Vaad announced that there are motions on the table from the previous meeting on L.005 and L.001 (Attachments A and B, respectively).

Representative Coram, prime sponsor, presented House Bill 12-1327. The bill repeals the requirement that a towing carrier maintain a $50,000 surety bond to pay a civil penalty assessed against it by the Public Utilities Commission (PUC). Instead, failure to pay a fine or civil penalty will result in:

• the immediate revocation of the towing carrier's operating authority;
• a five-year prohibition on reapplying for a new authority; and
• a five-year disqualification from obtaining or renewing any operating authority for the towing carrier, its owners, principals, officers, members, partners, and directors, and any other entity owned or operated by those parties. Witness testimony was heard at an earlier meeting.

A handout was distributed to the committee providing a comparison of prepared amendments to the bill (Attachment C). Representative Tyler withdrew his substitute motion on amendment L.001. Representative Looper withdrew her motion on L.005. Representative Coram distributed prepared amendment L.010 (Attachment D) and discussed Attachment C. Representative Coram discussed L.005 with L.010 and indicated that the amendments are a good compromise.

Ms. Clare Pramuk, Legislative Council Staff, came to the table to discuss Attachment C. Ms. Pramuk commented on expenditures associated with L.005. Representative Jones asked about L.005. Representative Coram responded that current law does nothing to protect an individual's car being towed.

Discussion ensued concerning opposition to, and support of, the amendments. Representative Tyler asked if the tow trucker industry could come to the table to comment on the amendments. Representative Vaad announced that any tow truck representatives that are present may testify if they wish.

Mr. Chuck Ford, representing the tow truck industry, came to the table and discussed the amendments to the bill. Mr. Ford discussed his role in the amendment process and his support for L.010. Mr. Ford responded to questions from the committee.

Representative Ramirez commented on L.005 and asked Representative Coram about reinstating of licenses. Representative Looper asked for information concerning the annual fee.

Mr. Ron Jack, representing the PUC, came to the table to respond to questions from the committee. Discussion ensued concerning language in L.005 and whether the PUC would support a conceptual amendment. Mr. Jack responded yes, and Representative Coram indicated that he would support a conceptual amendment as well. Mr. Jack commented on the $150 annual fee pursuant to L.005. Representative Young asked about multiple permits. Representative Looper asked about Attachment C. Discussion ensued concerning revenues under L.005 with L.010.
