12:17 PM -- House Bill 12-1051

Representative Vaad, chair, called the meeting to order. A quorum was present. Representative Scott, prime sponsor, presented House Bill 12-1051. The bill alters the definition of a salvage vehicle for the purposes of a title transfer. Broadly, a salvage vehicle is one which has been damaged beyond repair. Under current law, a salvage vehicle must be less than six years old at the time of damage. This bill eliminates this requirement. Representative Scott briefly discussed the provisions of the bill. Representative Scott distributed a handout describing the current process and how it will change under the bill (Attachment A). Mr. Jonathan Senft, Legislative Council Staff, came to the table to clarify the fiscal note.

Mr. Brian Stonecipher, representing Insurance Auto Auctions, testified in opposition to the bill. Mr. Stonecipher responded to questions from the committee. Committee discussion ensued concerning the bill.

12:31 PM --
Mr. Patrick Boyle, representing the Property Casualty Insurers Association of America, testified in opposition to the bill. Mr. Boyle said that the bill will result in more cars with salvage titles. Mr. Boyle responded to questions from the committee.

Mr. RJ Hicks, representing Colorado Auto Recyclers, testified in support of the bill. Mr. Hicks briefly discussed a handout that was distributed to the committee concerning the definition of a salvage vehicle pursuant to current law (Attachment B). Mr. Hicks discussed Attachment B and the value of used vehicles. Mr. Hicks responded to questions from the committee concerning branding of a vehicle.

Mr. James Kantz, representing the International Association of Auto Theft Investigators, and Mr. Bill Johnson, representing the Chiefs of Police, testified in support of the bill. Handouts were distributed to the committee (Attachments C and D). Mr. Johnson and Mr. Kantz briefly discussed the handouts. Mr. Johnson and Mr. Kantz responded to questions from the committee. The committee discussed how Colorado compares to other states in the definition of a salvage vehicle. Representative Looper asked about cloning of a motor vehicle's vehicle identification number (VIN) and associated penalties. Representative Young inquired about auto theft associated with salvage vehicles.
