Representative Bradford, prime sponsor, presented Senate Bill 12-101, concerning the authority of a local improvement district (LID). She explained that the bill allows local improvement districts (LIDs) to include noncontiguous territory of unincorporated areas of the county where a LID is located, and establishing a procedure for property owners to petition the county government for inclusion in, or exclusion from, LIDs. Local improvement districts are currently authorized to use sales tax revenue to conduct public improvements.

Jack Hilbert, Douglas County Commissioner and President of Colorado Counties, Inc., testified in support of the bill and discussed the formation of LIDs and the need for the bill to allow counties to include noncontiguous areas of a county. Mr. Hilbert responded to questions from the committee concerning the formation of LIDs, the need for counties to include noncontiguous areas into current LIDs, and the authority for LIDs to collect sales taxes for public improvements.

Bruce Warren, representing the Niwot Local Improvement District Advisory Committee and the Niwot Business Association, testified in support of the bill and talked about the benefits that LIDs provide to businesses in Niwot. Mr. Warren responded to questions from the committee concerning the process of forming LIDs and the ability for property owners to petition the county government for inclusion or exclusion from a LID. Committee discussion ensued concerning the need for the bill and how LIDs affect the local sales tax collection process. Representative Bradford distributed a handout to the committee members regarding the sales tax collection for LIDs on a sales tax return (Attachment A).
